These Terms and Conditions establish a legally binding agreement between you and Brainsor, operated by Rollion Sp. z.o.o, a company incorporated under the laws of  Poland with its registered address at street Hoża, No. 86, Apt/Room 210, 00-682, Warsaw, Poland and company registration number  527865284 (hereinafter “we,” “our,” or “us”) governing your use of the Brainsor website and the services offered through it.

Term And Termination

These Terms and Conditions shall remain in effect for 3 months from the date of service purchase or until terminated by you or Brainsor. Brainsor may, at its sole discretion, suspend or terminate these Terms and Conditions at any time with prior notice. Termination will be immediate and without prior notice from Brainsor if you fail to comply with any provision of these Terms and Conditions. You may also terminate these Terms and Conditions by deleting the website cookies and all copies from your device.

No Warranties

The Brainsor website is provided on an “as is” and “as available” basis without express or implied warranties. To the fullest extent permitted by law, Brainsor disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights.

Limitation Of Liability

In no event shall Brainsor, its directors, officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

The failure of Brainsor to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right or provision. The waiver of any breach of these Terms and Conditions will not operate as a waiver of any subsequent breach.

Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of these Terms and Conditions to arbitrate, shall be determined by arbitration in registered country before a single arbitrator. 

Notice Of Dispute

In the event of a dispute, you or Brainsor must provide written notice to the other party, setting forth the name, address, and contact information of the notifying party, the facts underlying the dispute, and the relief sought. You must send any Notice of Dispute via email to EMAIL. Accelerator will send any Notice of Dispute to you via mail, if available, or to your email address. The parties shall attempt to resolve the dispute through informal negotiation within sixty (60) days from receipt of the Notice of Dispute. If the dispute is unresolved within sixty (60) days, either party may commence arbitration.

Brainsor accepts payments made using the following card networks:

Card availability may depend on the issuing bank, card type, and applicable regional restrictions. Brainsor does not store full card details; all card payments are processed securely through authorised third-party payment service providers.

Refund Policy

Services purchased from https://brainsor.com/ may be eligible for reimbursement if cancelled within 30 days of the transaction. The transaction date for this Refund Policy is the date of service purchase or when Brainsor extends services following the relevant service agreement (Terms of Use). Services may be cancelled at any time, but a refund will only be granted if the request is made within the specified refund period for that service.

All refund requests must be made before services can be cancelled. No refund will be granted if your Service(s) are suspended or terminated for cause. All refunds are processed in EUR, and you, the customer, assume full responsibility for any exchange rate fluctuations between the payment and refund times.

User Conduct

Users are expected to conduct themselves respectfully and lawfully while using the Brainsor platform. This includes refraining from engaging in any activity that may disrupt or interfere with the platform’s operation or other users’ experience. Prohibited conduct includes but is not limited to harassment, impersonation, spamming, or posting offensive material.

Account Security

Users are responsible for maintaining the security of their accounts and passwords. You agree not to share your account credentials with any third party and to notify Brainsor immediately if you suspect unauthorised access to your account. Brainsor shall not be liable for any loss or damage arising from unauthorised access to your account.

Feedback and Suggestions

Brainsor welcomes users’ feedback, suggestions, and ideas regarding the platform and its services. By submitting feedback or suggestions, you grant Brainsor the right to use, modify, and incorporate your input into its products and services without any obligation to compensate you.

Brainsor makes no representations or warranties regarding the quality, reliability, or suitability of any products or services advertised or promoted on the platform.

No Agency Relationship

Nothing in these Terms and Conditions shall be construed as creating a partnership, joint venture, employment, or agency relationship between you and Brainsor. You agree that you are an independent contractor, not an employee, agent, or representative of Brainsor.

Force Majeure

Brainsor shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, strikes, or government actions.

Assignment

You may not assign or transfer any of your rights or obligations under these Terms and Conditions without the prior written consent of Brainsor. Brainsor may freely assign or transfer its rights and obligations under these Terms and Conditions without restriction.

Survival

The provisions of these Terms and Conditions that by their nature should survive termination shall survive any termination or expiration of these Terms and Conditions, including but not limited to the sections on Intellectual Property Rights, Limitation of Liability, Indemnification, and Arbitration Agreement.

These Terms and Conditions constitute the entire agreement between you and Brainsor regarding the use of the platform, superseding any prior agreements or understandings, whether oral or written.

These Terms and Conditions are provided in English. Any translations of these Terms and Conditions are provided for convenience only, and the English version shall prevail in case of discrepancies.
